Contracting party
Your contract is with Govanalytics B.V., Bergsingel 124, 3037 GM Rotterdam, the Netherlands, Chamber of Commerce (KvK) 42091943 ("we", "us"). The service is for businesses and public bodies, not for consumers.
These are our standard terms. They apply to all agreements unless you and we have agreed otherwise in writing. Are you a public-sector organisation with your own procurement conditions such as ARVODI, ARBIT or GIBit? Contact us — for Organisation and Enterprise plans, deviating terms can be agreed upon. A signed order form always takes precedence.
The service
| Plan | What we do with your analytics data |
|---|---|
| Cloud Dashboard | We collect it and store it for you in a database we host in the EU, with dashboards and Ask AI |
| Cloud Warehouse | We collect and process it and forward it to storage you own, such as BigQuery or ClickHouse. We do not keep it after delivery |
| Self-hosted | You run the open-source software on your own infrastructure under its MIT licence. These terms apply to the support you buy from us |
Plan limits and prices are on our pricing page or in your order form.
Self-hosted support requires you to give us remote access to the deployment so we can install, update and troubleshoot it. We use that access only to provide support, and our Data Processing Agreement applies to any personal data we can reach.
Your account
- Keep your login details secure, and tell us at security@govanalytics.nl if you suspect misuse.
- You are responsible for the people you invite and for everything done through your account, including by AI assistants you connect.
- Organisation admins control who has access, Ask AI settings and which connectors are authorised.
Free plans
Govanalytics offers the following plans; a full overview of limits and prices is on the pricing page.
Trial and Start are our free and entry-level plans. Our own terms of service always apply to these plans; deviating procurement terms (such as ARVODI, ARBIT or GIBit) do not apply, unless explicitly agreed otherwise.
Higher plans. For Organisation and Enterprise plans it is possible to agree on deviating terms, including your own procurement conditions. Please contact us to discuss the options.
- Free plans are provided as they are, without any commitment on availability, support or features.
- Each plan has usage limits. Above the limit, we may stop accepting events, sample them or ask you to upgrade. We are not liable for data that was not collected because a limit was reached.
- We may change or end a free plan, or the features in it, with 30 days' notice.
- Free accounts with no tracked events or logins for 12 months may be closed after 30 days' notice by email, and their data deleted.
- Features marked beta or preview are provided as they are and may change or be withdrawn without notice.
Your data
- You own it. You keep all rights to the analytics data you send us and to your reports and settings.
- Your responsibility as controller. You make sure you may collect the data: a privacy notice on your site, consent where the law requires it, and no special categories of personal data. You indemnify us against claims from third parties or authorities caused by data you should not have collected.
- Data Processing Agreement. Our DPA applies when we process personal data for you and forms part of these terms.
- Used only for you. We use your data only to provide, secure and support the service for you. We do not sell it, and we do not use it or your Ask AI conversations to train AI models. Model providers reached through OpenRouter apply their own data policies.
Ask AI and connectors
- Ask AI is on by default for every property. An organisation admin can switch it off.
- We route Ask AI requests through OpenRouter to the model that gives the best results for the cost, and we may change the model at any time. Model providers may process requests outside the EU.
- Answers are generated by a language model and can be wrong. Check important figures against your reports before you rely on them.
- Our connectors let an AI assistant you choose, such as Claude, read your analytics and help install and configure tracking. They cannot change or delete collected analytics data. When you connect one, you instruct us to send it the results of the tools it calls; from then on, the assistant's provider handles the data under its own terms.
Acceptable use
You may not:
- send data you have no right to collect, or use the service to track people unlawfully;
- send passwords, payment card numbers or special categories of personal data in events;
- try to access other customers' data, probe our systems without written permission, or overload the service;
- resell the service, or use it to build a competing product, without our written agreement.
We may suspend access straight away to stop a breach of these rules or a threat to the service. We will tell you why and restore access once the problem is fixed.
Payment
Paid plans are billed in advance by card, monthly or yearly, and renew automatically until cancelled.
- Prices exclude VAT.
- If a payment fails, we may suspend the service after 14 days. Overdue amounts bear the Dutch statutory commercial interest, plus reasonable collection costs.
- We may change prices with 30 days' notice. The new price applies from your next billing period, and you may cancel before it does.
- Fees already paid are not refunded, including when you cancel or downgrade mid-period.
Availability
We work to keep the service available and announce planned maintenance in advance, but on standard plans we give no guarantee on uptime or support response times.
Term
- You can cancel at any time in the app or by email. Cancellation takes effect at the end of the paid period.
- We can end the agreement with 30 days' notice, or immediately if you seriously breach these terms.
- Your data at the end. You have 30 days after the end of the agreement to export your data. After that we delete it, including from backups within a further 30 days.
Intellectual property
The Govanalytics pipeline is open source under the MIT licence. Our hosted service, app, branding and documentation remain ours. You get a non-exclusive, non-transferable right to use the service during your subscription. We may use any feedback you send us freely.
Customer references
You allow us to use your organisation's name and logo in our sales and marketing materials, such as our website, presentations, proposals, customer lists, case studies and social media, during the agreement and for 12 months after it ends. You can withdraw this at any time by emailing legal@govanalytics.nl; we then stop using them in new materials within 30 days.
Liability
- Our total liability per calendar year is limited to the fees you paid us in the 12 months before the event. On free plans it is limited to EUR 100.
- We are not liable for indirect or consequential loss, such as lost profit, lost revenue, lost data or reputational damage.
- We are not liable for loss or incidents in systems you control, such as your own cloud project, data warehouse or self-hosted environment.
- Claims expire if you do not bring them within 12 months after you learned of the event.
- These limits do not apply to intent or deliberate recklessness of our management.
No other warranties
Apart from what these terms promise, the service is provided as it is, to the extent the law allows.
Force majeure
Neither party is liable for failures caused by events outside its reasonable control, such as outages at a cloud or network provider, a cyberattack we could not reasonably prevent, or government measures.
Confidentiality
Each party keeps the other's non-public information confidential and uses it only for this agreement. This survives the end of the agreement.
Changes
We may change these terms. We announce material changes by email or in the app at least 30 days before they apply. If you keep using the service after that, you accept the new terms; if you don't agree, you can cancel before they take effect.
Transfer
We may transfer this agreement to a group company or to a buyer of our business. We will tell you when we do.
Governing law
Dutch law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Disputes go to the competent court in Rotterdam, the Netherlands.
